CIRCUMSTANCES OF OFFENSE: The Defendant was placed on probation on May
16, 2014, for a 10 year deferred adjudication probation for the offense of Sexual Assault
of a Child. On May 4, 2018, a motion to revoke the Defendant’s probation was filed
alleging multiple probation violations. The Defendant plead true to all violations of the
Motion to Revoke.
Appellate issues delayed the completion of this case until now. A punishment hearing
took place on March, 12, 2024, with Judge Barbara Walther presiding. During the
punishment phase of the trial the State called former Concho Valley Community
Supervision and Corrections Department officer Maggie Smith and licensed sex offender
treatment provider, Emily Orozco to testify to the defendant’s probation and sex offender
therapy violations. The victim of the underlying offense also testified as to how this has
deeply impacted her life.
After hearing the evidence, Judge Walther sentenced the defendant to 50 years
confinement in the penitentiary. Comment: We applaud the young lady who had the strength and courage to take the stand and confront her perpetrator. We hope that this will start the healing and recovery process and that she can now move forward from this awful period in her life.

CIRCUNSTANCIAS DEL DELITO: El acusado fue puesto en libertad condicional en mayo
16 de diciembre de 2014, para una libertad condicional de adjudicación diferida de 10 años por el delito de agresión sexual de un Niño. El 4 de mayo de 2018 se presentó una moción para revocar la libertad condicional del demandado. Alegando múltiples violaciones de la libertad condicional. El demandado se declara fiel a todas las violaciones de la Moción para revocar.
Las cuestiones de apelación retrasaron la finalización de este caso hasta ahora. Una audiencia de castigotuvo lugar el 12 de marzo de 2024, presidida por la jueza Barbara Walther. Durante el Fase de sanción del juicio que el Estado convocó a la ex Comunidad del Valle del Concho Maggie Smith, oficial del Departamento de Supervisión y Correcciones, y delincuente sexual autorizado. La proveedora de tratamiento, Emily Orozco, testificará sobre la libertad condicional y el delincuente sexual del acusado.violaciones de la terapia. La víctima del delito subyacente también testificó sobre cómo esto ha impactó profundamente su vida.
Tras escuchar las pruebas, el juez Walther condenó al acusado a 50 añosreclusión en el centro penitenciario.
Comentario: Aplaudimos a la joven que tuvo la fuerza y el coraje de tomar y
ponerse de pie y confrontar a su perpetrador. Esperamos que esto inicie la curación y la recuperación y proceso y que ahora puede salir adelante de este terrible período de su vida.
